Effective Date: October 3, 2026 · Last Updated: October 3, 2026
These Terms of Service (“Terms”) govern your use of the website located at jankiyoga.com (the “Site”), the Janki Yoga iOS application and the Janki Yoga web application at app.jankiyoga.com (together, the “App”), and the related yoga instruction, consultation, and scheduling services offered through the Site or the App (collectively, the “Services”). Janki Yoga (“Janki Yoga,” “we,” or “us”) is a sole proprietorship organized under the laws of the State of Illinois. By accessing the Services, you agree to be bound by these Terms.
1. Acceptance of these Terms
By using the Services, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree to these Terms, do not use the Services.
2. Eligibility
The Services are intended for adults aged eighteen (18) and older. Individuals aged thirteen (13) through seventeen (17) may use the Services only with the express consent and supervision of a parent or legal guardian, and only after completing the in-App participation consent process. The Services are not directed to, and we do not knowingly collect Personal Information from, children under the age of thirteen (or sixteen where required by the European Union General Data Protection Regulation).
3. Your Account
To use most features of the App, you must sign in using Sign in with Apple or Google and enter an invitation code provided by the Instructor. You are responsible for all activity that occurs under your account, for safeguarding your sign-in credentials, and for promptly notifying us of any unauthorized access. You may not share your account credentials with any other person.
4. The Services
The Services provide online tools for booking, attending, and reflecting on private and small-group yoga sessions taught by Janki Patel (the “Instructor”). The Services currently include: booking small-group classes; booking private one-on-one sessions, consisting of a free introductory conversation that the Instructor confirms before it is scheduled and paid private sessions; takeaways and home-practice suggestions written by the Instructor after a session; practice tracking and a personal progress view; body check-ins you may choose to share with the Instructor; messages with the Instructor and announcements from the Instructor; and a library of practice materials curated by the Instructor. Sessions are taught live, by video conference (currently Microsoft Teams) or in person, directly between you and the Instructor.
4.1 Fees and Payment
Small-group classes and the introductory conversation are currently offered free of charge. Private sessions are paid. The price and length of a paid session are shown to you in the App before you pay, and you are charged when you book. Payments are processed by our payment processor, Stripe, Inc. (“Stripe”), by card or by a digital wallet such as Apple Pay or Google Pay. Your card and wallet details are submitted directly to Stripe and are not received or stored by Janki Yoga. Your use of Stripe’s payment services is also subject to Stripe’s terms. We may change prices or introduce other paid features in the future; any change will not affect a session you have already paid for, and pricing for any new paid feature will be presented to you before you are charged.
4.2 Cancellations, Rescheduling, and Refunds
You may cancel a paid private session in the App at any time before it starts and receive a full refund to your original payment method. You may also move a booked session to another available time before it starts at no additional charge. If the Instructor cancels a paid session, or if the time you selected becomes unavailable while your payment is being processed, you will receive a full refund. A session that has started or has passed is not eligible for an automatic refund, although the Instructor may issue a refund at her discretion. Refunds are issued through Stripe and usually appear on your statement within five (5) to ten (10) business days, depending on your bank or card issuer. Deleting your account cancels and fully refunds any upcoming paid sessions, as described in Section 8.
5. Health and Safety Disclaimer
Yoga involves physical activity and carries inherent risk of injury, including but not limited to muscle strain, joint injury, and aggravation of pre-existing medical conditions. The Services are not, and are not intended to be, medical advice, diagnosis, treatment, or a substitute for professional medical guidance. You should consult a qualified physician before beginning any new yoga practice, and you should stop practicing immediately and seek medical attention if you experience pain, dizziness, or any other concerning symptom. By using the Services and by submitting the in-App participation consent form, you acknowledge and accept these risks.
6. Your Content
The Services allow you to submit content, including body check-ins, practice entries, optional written notes shared with the Instructor, messages, and any other information you choose to upload or transmit through the Services (“Your Content”). You retain all rights you may have in Your Content. By submitting Your Content to the Services, you grant Janki Yoga a non-exclusive, worldwide, royalty-free license to host, store, display, and otherwise process Your Content solely for the purpose of providing the Services to you and to the Instructor. You represent that you have all rights necessary to grant this license and that Your Content does not violate any law or infringe the rights of any third party.
7. Acceptable Use
You agree that you will not, and will not attempt to:
- use the Services in any manner that violates applicable law or that infringes the rights of any third party;
- upload or transmit content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable;
- abuse, harass, threaten, or impersonate the Instructor or any other user of the Services;
- interfere with, disrupt, or attempt to gain unauthorized access to the Services or to any servers or networks connected to the Services;
- reverse engineer, decompile, or otherwise attempt to derive the source code of any portion of the Services, except to the extent applicable law expressly prohibits such restriction;
- use any automated means (including scrapers, bots, or spiders) to access the Services or to collect data from the Services without our prior written consent.
8. Termination
You may terminate your account at any time by selecting Settings → Delete my account within the App. Deleting your account cancels any upcoming private sessions and fully refunds those you paid for. Deletion is otherwise governed by Section 10.1 of our Privacy Policy. We may suspend or terminate your access to the Services, with or without notice, if we determine in our reasonable judgment that you have violated these Terms or that your continued use poses a risk to us, to the Instructor, or to other users.
9. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL JANKI YOGA, THE INSTRUCTOR, OR ANY OF OUR RESPECTIVE AFFILIATES, OFFICERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
11. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of those courts.
12. Changes to these Terms
We may update these Terms from time to time to reflect changes in our practices, the Services, or applicable law. When we do, we will revise the “Last Updated” date at the top of these Terms. Where changes are material, we will provide additional notice in the App or by email where reasonably practicable. Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.
